§1 Definitions

1. Terms and Conditions – these Terms and Conditions set out the rules for concluding distance sales contracts via the Online Store, the rules for performance of such contracts, the rights and obligations of the parties, and the complaint procedure. With regard to electronic services, these Terms constitute the regulations referred to in Article 8 of the Act on Providing Services by Electronic Means.
   

2. Customer – a natural person with full legal capacity, a legal person, or an organizational unit with legal capacity, concluding a distance sales contract with the Seller.
   

3. Consumer – a natural person who performs a legal act not directly related to their business or professional activity.
   

4. Entrepreneur with Consumer Rights – a natural person concluding a contract related to business activity where, based on the content of the contract, it does not have a professional character.
   

5. Entrepreneur – an entity conducting business or professional activity.

7. Online Store – the store operating at: https://shbikinis.com
   

8. Distance Sales Contract – a contract concluded via the Online Store.
   

9. Goods – movable items offered for sale in the Store.
   

10. Digital Content – data produced and supplied in digital form.
    

11. Digital Service – a service enabling the processing, storage, or access to digital data.
    

12. Durable Medium – a medium enabling the storage of information in a way that allows access to it in the future (e.g. e-mail, PDF).
    

13. Order Form – an electronic form used to place orders.
    

14. Account – a set of Customer data stored in the Store system enabling order placement.
    

§2 General Provisions

1. The Store enables:
   
   • concluding online sales contracts
   
   • creating and maintaining an account
   
   • adding product reviews
   
   • receiving order confirmations via e-mail
   

2. Minimum technical requirements:
   
   • up-to-date web browser (Chrome, Firefox, Edge, Safari)
   
   • PDF support
   
   • Internet access
   

3. Product and price information constitutes an invitation to conclude a contract within the meaning of Article 71 of the Polish Civil Code.
   

4. These Terms and Conditions are available on the Store website and can be saved by the Customer.
   

5. The Seller applies security measures to protect Customers' data.
   

§3 Placing Orders

1. Orders may be placed:
   
   • via a Customer Account
   
   • without registration
   

2. Placing an order requires:
   
   • adding products to the cart
   
   • completing the order form
   
   • accepting the Terms and Conditions
   
   • clicking the order confirmation button
   

3. After placing an order, the Customer receives an e-mail confirming conclusion of the contract.
   

4. Until order processing begins, the Customer may modify or cancel the order.
   

5. Order processing time: 1–25 business days.
   

§4 Payments

2. Payment is made using the method selected when placing the order.
   

§5 Delivery

2. If a parcel is not collected, the Seller may withdraw from the contract after notifying the Customer.
   

3. In such case, the refund shall be made immediately.
   

§6 Right of Withdrawal (Returns)

1. A Consumer and an Entrepreneur with Consumer Rights have the right to withdraw from a distance contract within 14 days without giving any reason.
   

2. The withdrawal period expires after 14 days from the day the Customer (or a third party designated by the Customer, other than the carrier) takes possession of the Goods.
   

3. To exercise the right of withdrawal, the Customer must inform the Seller by a clear statement sent to:

4. To meet the deadline, it is sufficient to send the statement before the withdrawal period expires.
   

§7 Effects of Withdrawal

1. In the event of withdrawal, the Seller shall refund all payments received, including the cost of the cheapest available delivery method.
   

2. The refund shall be made no later than 14 days from the day the Seller receives the withdrawal statement.
   

3. The Seller may withhold the refund until the Goods are received back or the Customer provides proof of return.
   

4. The refund will be made using the same payment method as used in the original transaction, unless the Customer agrees otherwise.
   

5. The Customer bears the direct cost of returning the Goods.
   

6. The Customer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
   

§8 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

1. Goods made to the Customer’s specifications or clearly personalized
   

2. Sealed goods which, once opened, cannot be returned for health or hygiene reasons
   

This applies in particular to:

• thongs

• underwear

• intimate products

• goods with a hygiene seal after removal of such seal

§9 Complaints – Non-conformity of Goods

1. The Seller is liable to the Consumer for conformity of the Goods with the contract in accordance with the Consumer Rights Act.
   

2. Complaints may be submitted electronically to:

3. A complaint should include:
   
   • order number
   
   • description of the issue
   
   • photos (if possible)
   
   • Customer’s request
   

4. The Seller shall consider the complaint within 14 days.
   

5. If the complaint is accepted, the Seller shall:
   
   • repair the product, or
   
   • replace the product, or
   
   • reduce the price, or
   
   • refund the payment – in accordance with applicable law.
   

§10 Complaint Procedure

1. The Customer may be asked to return the complained product for verification.
   

2. If the complaint is accepted, the Seller covers the return shipping costs.
   

3. Complaints regarding transport damage should be reported immediately after receipt of the parcel.
   

§11 Customer Account and Electronic Services

1. Creating an account is voluntary and free of charge.
   

2. The account allows:
   
   • placing orders
   
   • viewing order history
   
   • saving shipping details
   

3. The Customer is obliged to provide truthful data.
   

4. The Customer may delete the account at any time by contacting the Seller via e-mail.
   

5. The Seller may block the account in the event of violation of these Terms.
   

§12 Intellectual Property

1. All content in the Store, including in particular:
   
   • photographs
   
   • product descriptions
   
   • graphics
   
   • logo
   
   • brand name SHbikini / SHbikinis
   
   is protected by copyright law.
   

2. Copying, distributing, or using the content without the Seller’s consent is prohibited.
   

§13 Personal Data

1. Personal data are processed in accordance with applicable law and the Store’s Privacy Policy.
   

2. The Seller is the data controller.
   

3. Detailed rules on data processing are set out in the Privacy Policy available on the Store website.
   

§14 Liability

1. The Seller is not liable for:
   
   • technical interruptions in the operation of the Store
   
   • errors resulting from incorrect use of the website
   
   • providing incorrect data by the Customer
   

2. Liability towards Entrepreneurs (non-consumers) is limited to the value of the order.
   

§15 Dispute Resolution

1. Consumers may use out-of-court methods of complaint and claim resolution.
   

2. The European ODR platform is available at:

3. Polish law shall apply.
   

4. Disputes shall be resolved by the competent court in accordance with applicable law.
   

§16 Final Provisions

1. These Terms and Conditions enter into force on the date of publication on the Store website.
   

2. The Seller reserves the right to amend these Terms for important legal or organizational reasons.
   

3. Contracts concluded before the amendment are governed by the version of the Terms in force at the time of contract conclusion.
   

4. The Terms are available on the Store website in a form allowing them to be downloaded and saved.
