Terms and Conditions – these Terms and Conditions set out the rules for concluding distance sales contracts via the Online Store, the rules for performance of such contracts, the rights and obligations of the parties, and the complaint procedure. With regard to electronic services, these Terms constitute the regulations referred to in Article 8 of the Act on Providing Services by Electronic Means.
Customer – a natural person with full legal capacity, a legal person, or an organizational unit with legal capacity, concluding a distance sales contract with the Seller.
Consumer – a natural person who performs a legal act not directly related to their business or professional activity.
Entrepreneur with Consumer Rights – a natural person concluding a contract related to business activity where, based on the content of the contract, it does not have a professional character.
Entrepreneur – an entity conducting business or professional activity.
If a parcel is not collected, the Seller may withdraw from the contract after notifying the Customer.
In such case, the refund shall be made immediately.
§6 Right of Withdrawal (Returns)
A Consumer and an Entrepreneur with Consumer Rights have the right to withdraw from a distance contract within 14 days without giving any reason.
The withdrawal period expires after 14 days from the day the Customer (or a third party designated by the Customer, other than the carrier) takes possession of the Goods.
To exercise the right of withdrawal, the Customer must inform the Seller by a clear statement sent to:
To meet the deadline, it is sufficient to send the statement before the withdrawal period expires.
§7 Effects of Withdrawal
In the event of withdrawal, the Seller shall refund all payments received, including the cost of the cheapest available delivery method.
The refund shall be made no later than 14 days from the day the Seller receives the withdrawal statement.
The Seller may withhold the refund until the Goods are received back or the Customer provides proof of return.
The refund will be made using the same payment method as used in the original transaction, unless the Customer agrees otherwise.
The Customer bears the direct cost of returning the Goods.
The Customer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
§8 Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to:
Goods made to the Customer’s specifications or clearly personalized
Sealed goods which, once opened, cannot be returned for health or hygiene reasons
This applies in particular to:
• thongs
• underwear
• intimate products
• goods with a hygiene seal after removal of such seal
§9 Complaints – Non-conformity of Goods
The Seller is liable to the Consumer for conformity of the Goods with the contract in accordance with the Consumer Rights Act.
