Right of Withdrawal from Distance Contract for Consumers
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, craft, or profession.
Statutory Withdrawal Right
The consumer has the statutory right to withdraw from a distance contract within 14 (fourteen) days without giving any reason.
The withdrawal period expires after 14 days from the day on which the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods. In the case of multiple goods delivered under a single order — from the day the last item is received.
Exercising the Right of Withdrawal
To exercise the right of withdrawal, the consumer must notify the Seller of the decision to withdraw from the contract by means of an unequivocal statement sent by email to: shop@shbikinis.com
The consumer may use the model withdrawal form provided below, but this is not mandatory.
To meet the withdrawal deadline, it is sufficient to send the withdrawal notice before the withdrawal period has expired.
Effects of Withdrawal
In the event of withdrawal, the Seller shall reimburse all payments received from the consumer, including the cost of the least expensive standard delivery method offered by the Seller, without undue delay and no later than 14 days from the date of receipt of the withdrawal notice.
Additional costs resulting from the consumer’s choice of a delivery method other than the least expensive standard delivery offered shall not be reimbursed.
Reimbursement will be made using the same payment method used in the original transaction, unless expressly agreed otherwise. No fees will be charged for the reimbursement.
The Seller may withhold reimbursement until the goods are returned.
The consumer must return the goods without undue delay and no later than 14 days from the day of withdrawal notification. The deadline is met if the goods are sent before the 14-day period expires.
The consumer bears the direct cost of returning the goods.
The consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusions from the Right of Withdrawal
The right of withdrawal does not apply to contracts for:
goods made to the consumer’s specifications or clearly personalized,
non-prefabricated goods produced based on individual selection.
The right of withdrawal expires early for contracts concerning:
sealed goods not suitable for return for health protection or hygiene reasons once unsealed after delivery, including underwear and intimate garments,
goods which after delivery have been inseparably mixed with other items due to their nature.
